Frank Pasquale on Toward a Fourth Law of Robotics: Preserving Attribution, Responsibility, and Explainability in an Algorithmic Society

Frank Pasquale在SSRN上面發表了一篇文章:Toward a Fourth Law of Robotics: Preserving Attribution, Responsibility, and Explainability in an Algorithmic Society,這一篇文章所要回應的對象是Jack Balkin的The Three Laws of Robotics in the Age of Big Data。這兩篇文章都很推薦,基本上應該先念Jack Balkin的再來看Frank Pasquale的文章。但是,Pasquale這一篇的基本重點是,Balkin對於大數據時代下的演算法以及機器人之三個基本法則的提出都大致同意,但是Balkin的想法仍然是關注在讓特定的個人對於其創造物負責任,但是Pasquale認為我們應該可以預期在未來應該具有完全自主的機器人或是軟體的產生,因此如果我們僅關注特定個人所創造的機器人、演算法或是人工智慧,會忽視了這種具有自主性的機器人的部分。Pasquale這一篇文章認為,要避免這種unmooring machine需要第四法則:we may nedd to ensure that robots and algorithmic agents are traceable to and identified with their creators. 強烈推薦Jack Balkin跟Frank Pasquale的這兩篇文章

此外,部落格在兩年前也轉載過Jack Balki更早討論過機器人法則的文章,也一併提供給有興趣的人參考(Jack Balkin on The Path of Robotics Law)!我自己的切入角度是Frank Pasquale所探討的這種「完全自主的」機器人是真的可能的,我們可能需要更進一步思考假設此類機器人真的產生的話,他們的法律資格(是被視作人還是物)到底是什麼?這涉及到了更基礎的心靈哲學與行動哲學的討論,是一個很難的課題!
